Serious bodily injury in Dutch criminal law: definition and evidence

Serious bodily injury (zwaar lichamelijk letsel) is the legal qualification that turns պարզ հարձակում into aggravated assault under Dutch քրեական օրենք. Article 82 of the Dutch Criminal Code (Sr) lists injuries that always count as serious, but the list is not exhaustive: the criminal court may also qualify other injuries as serious, based on the nature of the injury, the medical treatment and the prospect of recovery.

This article explains what Article 82 Sr covers, how the Supreme Court (Hoge Raad) directs the assessment, when psychological harm qualifies and which medical evidence the prosecution must produce.

What does Article 82 Sr say?

Article 82 Sr does not give a full definition: it names injuries that must in any event be treated as serious. Other injuries can qualify as well.

The first paragraph names three cases: an illness that leaves no prospect of complete recovery, a lasting inability to perform one’s official or professional duties, and the miscarriage or death of the unborn child of a woman. The second paragraph adds a disturbance of the mental faculties that has lasted longer than four weeks.

The list sets a floor, not a ceiling. Injuries on the list always qualify, and the court may qualify other injuries as serious too. That is why case law, rather than the statutory text, decides most cases.

Why does the qualification matter?

The qualification decides whether the charge is simple assault (mishandeling, Article 300 Sr) or aggravated assault (zware mishandeling, Article 302 Sr). The maximum sentence more than doubles.

  • Simple assault (Article 300 Sr): maximum three years’ imprisonment; four years if serious bodily injury results without intent; six years if death results.
  • Aggravated assault (Article 302 Sr): intentionally inflicting serious bodily injury, maximum eight years; ten years if death results.
  • Aggravated assault with premeditation (Article 303 Sr): maximum twelve years; fifteen years if death results.
  • Aggravating circumstances (Article 304 Sr): the prison sentences of Articles 300-303 Sr can be increased by one third, for example where the victim is a partner, a child or a public official on duty.

The qualification also affects the proceedings. Pre-trial detention (voorlopige hechtenis) is in principle possible for offences carrying four years or more (Article 67 of the Code of Criminal Procedure, Sv), and an aggravated assault case is more often heard by a three-judge chamber than by a single judge (politierechter). What happens at a Նիդեռլանդներում քրեական դատարանի նիստ therefore depends on the article charged.

How do the courts decide whether an injury is serious?

Outside the statutory list, an injury is serious if ordinary language would call it serious. The Supreme Court has given three points of reference: the nature of the injury, the need for and nature of medical treatment, and the prospect of recovery.

These points of reference are not cumulative conditions; the court may combine them. What the Supreme Court does require is reasoning. If the injury falls outside Article 82 Sr, the judgment must show which facts about treatment and recovery led to the qualification. Judgments that only state “serious” without facts about treatment and prognosis have been quashed in cassation for insufficient reasoning.

The file therefore has to contain those facts. A charge of aggravated assault without material on surgery, hospital admission or remaining limitations is vulnerable on exactly that point.

Is a fracture always serious bodily injury?

No. A simple fracture that heals in a cast within a few weeks, without complications or lasting limitations, may remain simple assault under Article 300 Sr.

The dividing line in case law runs largely along the medical intervention. If a fracture requires surgery, hospital admission or a long recovery, the qualification usually follows. Fractures of the face or skull after kicks to the head are regularly qualified as serious.

When does loss of function count?

Permanent loss of function falls within the first paragraph of Article 82 Sr, because there is no prospect of complete recovery. Permanent hearing loss, loss of sight, paralysis and lasting disfigurement are assessed this way.

What these cases share is objective proof outside the victim’s own account: an operation, an admission, an audiological or ophthalmological measurement, a lasting limitation. The more the injury depends on how the victim experienced it, the harder the qualification becomes.

When does psychological harm count as serious bodily injury?

Only through the second paragraph of Article 82 Sr: a disturbance of the mental faculties that has lasted longer than four weeks. The Supreme Court applies this restrictively.

Serious psychological consequences, including post-traumatic stress disorder (PTSD), do not as such count as serious bodily injury unless that statutory criterion is met. The four-week period is a hard threshold: an acute stress reaction that fades within a few weeks does not qualify, however intense it was.

The disturbance must also be established objectively, in practice by a report from a psychiatrist or clinical psychologist. A note from a general practitioner about stress complaints does not meet that standard. Psychological harm that does not meet the threshold can still weigh in sentencing and in the injured party’s claim.

Which medical evidence must the prosecution produce?

The Public Prosecution Service (Openbaar Ministerie) must prove the charge. The court may find it proved only if it is convinced on the basis of lawful means of evidence examined at the hearing (Article 338 Sv).

For serious bodily injury, the medical file is that evidence: a medical statement, an emergency department report, an operation report or a forensic medical report describing the injury, the treatment and the prognosis. If the file contains only the victim’s statement about pain, the court may find assault proved but reject the aggravated qualification.

The new Code of Criminal Procedure has been adopted, with entry into force planned for 2029; no firm date has been set. Until then the current Article 338 Sv applies. Article 82 Sr is not affected by that reform.

What does the qualification mean for the victim?

A victim who suffered direct damage can join the criminal case as an injured party (benadeelde partij) and claim compensation there (Article 51f Sv). Serious bodily injury usually means a larger claim.

The criminal court decides on the claim together with the criminal case. If handling the claim would place a disproportionate burden on the criminal proceedings, the court can declare the claim (partly) inadmissible, leaving the victim to go to the civil court (Article 361(3) Sv). The rules on ոչ նյութական վնասի փոխհատուցում are the same as in civil proceedings. The calculation of a personal-injury claim itself is a matter for a personal-injury specialist.

Ի՞նչ պետք է ստուգել որպես կասկածյալ։

For the defence, the qualification is often the most productive point: it does not require denying the incident. Ask a քրեական պաշտպանության փաստաբան to test the medical file early.

  • Check whether the file contains a medical statement or report, or only the victim’s own account.
  • Check whether surgery was actually necessary or merely one treatment option.
  • Check how long recovery actually took and whether limitations are described as permanent or temporary.
  • For psychological harm, check whether a psychiatrist or psychologist established a disturbance lasting longer than four weeks.
  • Check whether the report distinguishes between findings and assumptions.
  • Check whether an alternative charge under Article 300 Sr is included in the summons.

Ի՞նչ պետք է ստուգեք որպես զոհ։

As a victim, you help the court by securing the medical evidence early, while treatment is ongoing. A report drawn up months later rarely says what the court needs.

  • Report the offence to the police and keep the report number.
  • Ask your treating doctor or hospital for a medical statement describing injury, treatment and prognosis.
  • Keep records of surgery, hospital admission, physiotherapy and time off work.
  • For psychological complaints lasting longer than four weeks, ask for assessment by a psychiatrist or psychologist.
  • Submit your injured-party claim form before the hearing, with supporting documents.
