Changing your child’s registered first name in the Netherlands is only possible through the district court (rechtbank), and only if there is a sufficiently weighty reason for the change. The parent with parental authority (gezag) or the guardian files the request through a lawyer; children aged 8 and older are invited by the court to give their view.

The rules are in Article 1:4 of the Dutch Civil Code (BW). The court grants the request if the change serves a weighty interest and the new name is not inappropriate and not identical to an existing surname, unless that is also a common first name.

The court looks at the child’s own situation, not at an abstract standard. Grounds the Dutch judiciary (Rechtspraak) mentions include bullying, psychological distress, religion, adoption, a change of registered gender and a harmful meaning of the name in another language.

Yes. If a child has used a different name at home and at school for years, that everyday use is strong evidence: school records, medical records and statements from teachers show that the interest is real.

The child’s own view also counts. The district court invites children aged 8 and older by letter for a conversation with the judge (kindgesprek), and as children grow older their wishes carry more weight.

What if the other parent does not agree?

If only one parent files the request, the lawyer must add a statement from the other parent agreeing to it, or explain why it is missing. The court notifies the other parent and, where relevant, the certified institution supervising the child, and both may object.

An objection can be made orally at the hearing or in a written defence (verweerschrift). A written defence must be filed by a lawyer, no later than 2 days before the hearing.

No. A spelling or transcription error on the birth certificate is a correction of the record, not a change of name, and does not require a weighty interest. Obvious errors can often be corrected through the municipality where the birth was registered; others need a separate, simpler court procedure.

A lawyer is mandatory: you cannot file the petition (verzoekschrift) yourself. The lawyer files it with the district court with a BRP extract, the birth certificate and an extract from the Central Custody Register (Centraal Gezagsregister).

The court often decides on the papers, but can hold a hearing at the court for your place of residence. The decision (beschikking) goes to your lawyer. You or an objecting parent can appeal to the court of appeal (gerechtshof) within three months, again through a lawyer.

Once the change is granted, the court sends the decision to the municipality where the child was born, or to The Hague municipality if the child was born abroad. The municipality then updates the name in the Personal Records Database (Basisregistratie Personen, BRP).

The court charges a filing fee (griffierecht) according to the civil fee table, plus the lawyer’s fees. Applicants with a low income can ask their municipality for special assistance (bijzondere bijstand) towards the court fees.

A surname change (geslachtsnaamswijziging) is a different procedure. It is decided administratively by Justis, part of the Ministry of Justice and Security, not by the court. See our guide to

What should you check as the parent filing the request?

  • Do you have parental authority, as shown in the Central Custody Register?
  • Do you have the other parent’s written consent, or a clear reason why it is missing?
  • Can you document the reason with school, medical or other records?
  • Has your child been using the new name, and is your child prepared for the conversation with the judge from age 8?

  • Have you received notice of the request and the date of the hearing?
  • Do you want to object, orally at the hearing or in writing through a lawyer at least 2 days before?
  • Is the reason for the change supported by facts, or mainly by the other parent’s wishes?
  • Do you want to appeal within three months if the request is granted?

What can we do for you with changing a child’s first name?

We handle these petitions as part of our

  • We assess whether your reason is likely to count as a weighty interest under Article 1:4 BW.
  • We draft and file the petition with the district court.
  • We represent you at the hearing, as the applicant or as the objecting parent.
  • We file or answer an appeal within the three-month deadline.

  • Only the district court can change a registered first name, under Article 1:4 BW, and only through a lawyer.
  • You need a weighty interest, judged on the child’s own situation, and an appropriate new name.
  • Children aged 8 and older are invited to give their view; the other parent can object.
  • Appeal is possible within three months; once granted, the municipality updates the BRP.
  • Correcting a simple error follows a different route; a surname change is decided by Justis.

Can my child change their first name without both parents agreeing?

Yes, a request by one parent is possible, but the lawyer must explain why the other parent has not consented. The other parent is notified by the court and can object.

From what age is my child heard?

The district court invites children aged 8 and older by letter for a conversation with the judge. Their view weighs more heavily as they get older.

There is no statutory term. A request decided on the papers is quicker; a hearing, an objection by the other parent or an appeal within the three-month term makes it longer.
